Andrew Mirsky


Andrew Mirsky has 12 years’ experience as a business and commercial lawyer, including 5 years’ experience in company management of media and technology enterprises. Mr. Mirsky began his law career in New York City at the corporate law firm of Kaye Scholer, LLP, focusing on corporate and finance transactions and advising clients in media, healthcare, securities, finance, manufacturing, and real estate. Mr. Mirsky left Kaye Scholer to work in-house at a client technology startup, with a business of supply-chain management technology.

Mr. Mirsky moved to Washington in 1999 and worked in Operations Management (Advertising Operations) at The Washington Post Company, before joining Atlantic Media Company as Director of Business Development and Legal Affairs. Atlantic is publisher of The Atlantic Monthly, National Journal magazine and Government Executive magazine. At Atlantic, Mr. Mirsky had lead responsibility for $2.5 million in new revenues; negotiated outsourcing contracts, web serving agreements, archival services and software and hardware technology licensing; structured and negotiated deals for syndication services, custom publishing, reselling/database licensing, and site licensing; and marketed name and brand services with core and target markets through television and radio partnerships, complimentary partners and legislative outlets.

Education

Mr. Mirsky has his law (1993) and undergraduate degrees (1990) from the University of Pennsylvania, in Philadelphia. He attended high school in Millburn, NJ (1986), and studied classical and jazz piano at the Manhattan School of Music (Preparatory Division), in New York City.

Stephen D. Kong

Steve Kong specializes in the areas of commercial litigation and employment law.  Mr. Kong represents companies and individuals in Federal and State court cases, as well in arbitrations and administrative proceedings including EEO and MSPB hearings.  He also advises clients on labor and employment “best practices” that serve to minimize the risk of future litigation. 

Mr. Kong’s legal background is quite varied, with extensive litigation and legal management experience in both the private and government sectors.  He has achieved great success in multi-million dollar cases and demonstrated his ability to effectively lead and manage large teams.

Most recently, Mr. Kong was the Deputy General Counsel and former Acting General Counsel of the U.S. Small Business Administration in Washington, D.C.  In those capacities, he supervised the day-to-day operations of the 160-person staff in the Office of General Counsel and was actively involved in all of the Agency’s major legal decisions, ranging from employment litigation strategy to positions on small business legislation.

At Proskauer Rose LLP in New York City, Mr. Kong successfully represented clients in a $230 million asbestos case, a $200 million insurance litigation involving environmental remediation, and a $100 million contractual dispute over the recall of an anti-infection drug, among others.  Likewise, at Stroock & Stroock & Lavan, Mr. Kong achieved favorable results in a diverse collection of cases covering the insurance, real estate and securities industries.   

Following graduation from Fordham Law School, Mr. Kong joined the Brooklyn District Attorney’s Office as an Assistant District Attorney, and subsequently served as a Law Clerk for the Honorable Judith S. Kaye, the former Chief Judge of the New York State Court of Appeals and one of the most respected jurists in the country.

In addition to this legal experience, Mr. Kong has held positions with Andersen Consulting (now Accenture), Sterling Drug (now Sanofi-Aventis) and CPA Global, business experience that has given him valuable insight into the everyday needs and concerns of corporations and their employees.


Deborah B. Miller (Special Counsel)


Deborah Miller is special projects attorney to Mirsky and Company. Deborah Miller has 15 years of litigation and business law experience.  She began her career with the Philadelphia litigation firm of Conrad O’Brien Gelman & Rohn, and then joined Sprague and Sprague working for Richard A. Sprague, one of the nation’s premier trial attorneys.  Ms. Miller worked on various state and federal litigation and appellate matters including civil RICO, estates, domestic relations and high-profile defamation cases.  For the past nine years, Ms. Miller has been the principal of her own firm, servicing clients in a broad range of litigation and business matters in Pennsylvania and New Jersey, including employment, leasing, real estate, commercial collections, business agreements, media issues, estate litigation and domestic relations.  Ms. Miller began working with Andrew Mirsky and Mirsky and Company in 2007.

Education

Ms. Miller is a 1993 graduate of the University of Pennsylvania Law School where she served as associate editor of the Journal of Comparative Labor Law and was a member of the Women’s Law Group.  In January 1990, she graduated first from the School of Arts & Science from Lehigh University with a B.A. in Government where she ran track, served as an officer of the Debate Team and was a member of Kappa Alpha Theta sorority. 

Bar Admissions and Professional Activities

Ms. Miller is a member of the Pennsylvania and New Jersey bars, and is admitted to practice before the Supreme Court of Pennsylvania, the Eastern District of Pennsylvania, the Third Circuit, the Supreme Court of New Jersey, and the District of New Jersey.  She has participated in sections and committees of the Philadelphia (PBA) and Montgomery (MBA) County Bar Associations, including a PBA women’s mentoring group; MBA Intellectual Property and Communications Law Section; MBA Business, Banking and Corporate Counsel Section; and serving as recent past co-chair of the MBA General Practice Section.  Ms. Miller belongs to the Philadelphia Bar Association’s Business and Real Property sections, as well as the Philadelphia Interactive Marketing Association.    

Ms. Miller actively develops her professional reputation with speaking engagements and publishing on topics of interest, including serving as a presenter at continuing legal education seminars.  During the past year, she has presented on “Building and Evaluating a Business Chain, Part I of VI: Selecting the Right Business Entity” for the Montgomery County Bar Association, Franchise Committee; “Bank Confidentiality - Can You Trust your Bank?” and “Legal Issues in New Media: On-Line Publishing, Blogs and Social Networking Sites” as CAPE Institute CLE courses, and most recently co-authored, “New Media Business Matters: Fair Use, Licensing and Doing Business with Google,” Folio (August 2007), and “Fair Use in New Media,” Philadelphia Bar Quarterly (October 2007).
